Will
This is the Last Will and Testament of me ANNIE RUSHTON of 103 Ormerod Street Accrington in the County of Lancaster Widow.
1 I HEREBY REVOKE all former Wills and testamentary dispositions at any time heretofore made by me.
2 I APPOINT my friends William Westwell and his wife Maggie Westwell both of 90 Ormerod Street Accrington aforesaid (hereinafter called "my Trustees") to be Executors and Trustees of this my Will.
3 I DESIRE to be cremated (in a plain white shroud) at Accrington Crematorium and my ashes scattered on the Garden of Remembrance there. I earnestly wish my executors to ensure that there shall be no mourning nor flowers sent by any relatives or friends for my funeral but that instead donations may be given to Spring Hill Methodist Church Richmond Road Accrington aforesaid.
4 I DESIRE that my Trustees shall instruct Kirby & Hughes Funeral Service of 228 Blackburn Road Accrington aforesaid to undertake the arrangements for my funeral.
5 I DESIRE that my Trustees shall instruct Messrs. Barlow, Rowland & Co. Solicitors of 18 St. James' Street Accrington aforesaid to act for them in proving this my will.
6 I GIVE to each of my Trustees who shall prove this my Will and accept the trusts thereof the sum of Fifty pounds (£50) free of all duties and taxes.
7 I GIVE the following pecuniary legacies free of all duties and taxes:-
(a) To my god-daughter Ann Judith McMillan of 53 Crofton Road Orpington the sum of Three hundred pounds (£300).
(b) To my great-nephew Simon Franklin Margutti of 8 Dukes Road Billericay the sum of Two hundred pounds (£200).
(c) To my great-nephew Guy Victor Margutti of 48 Rowlands Close Cheshunt the sum of Two hundred pounds (£200).
(d) To my great-niece Christine Jane Rushton of 53 St John's Road Mogerhanger Bedford the sum of Two hundred pounds (£200).
(e) To my great-niece Kathryn Alicia Rushton of 53 St John's Road Mogerhanger Bedford the sum of Two hundred pounds (£200).
(f) To my great niece Lynn Mary Crossley of 2 Hartford Avenue Blackpool the sum of Two hundred pounds (£200).
(g) To my great-nephew Frank Wilkinson of 21 Kloup Road Shevington the sum of Two hundred pounds (£200).
(h) To my great-niece Carole Tyler of 174 Westmorland Avenue Blackpool the sum of Two hundred pounds (£200).
(i) To my great-niece Elaine Ibbotson of 40 Kingswood Crescent Roundhay Leeds the sum of Two hundred pounds (£200).
(j) To my nephew Derek Ellington Wakefield, JOX, 390 Quebec P2 Canada the sum of Two hundred pounds (£200).
(k) To Spring Hill Methodist Chapel Richmond Road Accrington the sum of Two hundred pounds (£200) (and I direct that the receipt of the Treasurer or other proper Officer for the time being of the said Chapel shall be a good discharge to my Trustees for the payment to the said Chapel of the said legacy).
(l) To my friend Miss Lizzie Knowles of 88 Ormerod Street Accrington the sum of One hundred pounds (£100).
(m) To my friend Sarah Wood of 106 Ormerod Street Accrington the sum of One hundred pounds (£100).
(n) To my sister-in-law Mrs Dobney of 4 Milton Road Colne the sum of One hundred pounds (£100).
(o) To my friend Laura Robinson of 91 Rawson Avenue Accrington the sum of One hundred pounds (£100).
(p) To Doctor K.L. Purnell of 84 Royds Avenue Accrington the sum of One hundred pounds (£100).
(q) I GIVE to Lancashire Area Health Authority the sum of Two hundred pounds (£200) and I direct that they shall hold One hundred pounds (£100) in trust for Accrington Victoria Hospital absolutely for the general purpose of that Hospital and the remaining One hundred pounds (£100) to Blackburn Royal Infirmary Blackburn and I further direct that the receipt of the Treasurer or other properly appointed officer for the time being of the said Authority shall be a good discharge to my Trustees for the payment to the said Authority of the said legacy.
8 SUBJECT as aforesaid I DEVISE AND BEQUEATH all my property whatsoever and wheresoever to my Trustees UPON TRUST for sale calling in and conversion (with full power in their absolute discretion to postpone such sale calling in and conversion for so long as they shall think fit without being liable for loss) AND I DIRECT my Trustees to hold the proceeds of such sale calling in and conversion and my ready money (after payment thereout of my debts funeral and testamentary expenses and all duties and taxes payable by reason of my death and any legacies given by this my will or any Codicil hereto) and such of my estate as remains for the time being unsold and unconverted IN TRUST for such of my nephews and nieces Anne Margutti, Mary Crossley, Mary Isobel Taylor, Doris Dettmer and Frank Rushton as shall be living at my death if more than one in equal shares.
IN WITNESS whereof I have hereunto set my hand to this my Will this twentieth day of January One thousand nine hundred and eighty one.
SIGNED by the said Annie Rushton as and for her last Will in the presence of us both being present at the same time who at her request in her presence and in the presence of each other have hereunto subscribed our names as witnesses.
